Scope of Services

ELAK Health provides healthcare navigation, advocacy, medication support, and wellness guidance. Our services are intended to complement — not replace — the care you receive from licensed physicians or emergency providers.

  • Consultations may occur via text, phone, video, or in person.
  • Licensed clinicians may provide medication reviews, reconciliation, counseling, and cost-saving recommendations.
  • Our staff may assist with appointment preparation, accompany visits when authorized, and summarize next steps.
  • Ongoing monitoring for chronic conditions and post-discharge follow-up may be provided.
  • Unlimited messaging is available during posted business hours; messages received outside those hours will be answered the next business day.
  • Not for Emergencies: Our services are not designed for urgent symptoms or emergencies. If you are experiencing a medical emergency, call 911 immediately.
  • Services may be updated, modified, or discontinued at any time, subject to clinician availability and technology access.

Eligibility and User Obligations

Services are intended for individuals age 18 or older residing in the United States.

  • By enrolling, you represent that the information you provide is accurate, complete, and current.
  • You agree to update information as necessary and to maintain the confidentiality of your communications with ELAK.

Payment and Membership Terms

  • Certain services require enrollment in a paid membership plan. Fees, billing frequency, and terms will be disclosed at the time of enrollment.
  • Payments are due as specified during signup and will renew automatically unless canceled.
  • Refunds, if any, will be subject to the terms provided at the time of purchase.

Intellectual Property

We strive to provide reliable, accessible, and high-quality support. However, the availability and scope of our services may change over time.

  • Services may be updated, expanded, or discontinued at our discretion.

  • Appointment times, clinician availability, and messaging response times depend on scheduling and technology access.

  • We may suspend or limit services if they are misused or if false information is provided.

  • While we work to ensure secure and continuous access, we cannot guarantee uninterrupted service or error-free operation.

  • ELAK Health is not responsible for delays or disruptions outside our control, including internet or telecommunications failures.

Prohibited Conduct

When using our website or services, you agree not to:

  • Use services for emergencies or urgent medical needs.

  • Provide false or misleading information.

  • Send abusive, threatening, or inappropriate communications.

  • Attempt unauthorized access to our systems or data.

  • Share ELAK materials for purposes outside your care or authorized coordination.

  • We strive to provide reliable and secure services but cannot guarantee uninterrupted access. ELAK Health is not responsible for delays or disruptions beyond our control, including internet or telecommunications failures.

  • We reserve the right to modify, suspend, or discontinue services at our discretion.

Disclaimer of Medical Advice

  • ELAK Health is not a medical practice and does not provide medical diagnosis, treatment, or prescriptions. Information shared is for educational and supportive purposes only.

  • Always consult your physician or qualified healthcare provider for medical advice. Do not delay or disregard professional care because of information obtained through ELAK Health.

Limitation of Liability

To the maximum extent permitted by law, ELAK Health, its clinicians, employees, and affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services.

This includes, but is not limited to:

  • Misunderstandings of information provided during consultations.

  • Missed or delayed communications.

  • Outcomes of medical decisions by you or your providers.

  • Reliance on third-party services, referrals, or resources.

In no event shall our total liability exceed the amount you paid for services during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless ELAK Health, its officers, employees, and affiliates from any claims, liabilities, damages, costs, or expenses arising from your misuse of our services, violation of these Terms, or breach of applicable law.

Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed under the laws of the State of California, without regard to its conflict-of-law principles.

  • Any dispute shall be resolved exclusively in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of those courts.

Modifications to Terms

  • We may revise these Terms from time to time. Updates will be posted on our website with a revised effective date. Your continued use of the services constitutes acceptance of the updated Terms.

Severability and Entire Agreement

  • If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ELAK Health regarding use of our services.
